I hope I am posting this in the correct place....
My fiance and I own a home on a private airfield in Washington state. We, along with approx. 5 other homes, have easement/flying rights to this landing strip. None of us however actually own the land the strip is on.....and it's recently been sold to a contractor who wants to develope this land and build on it.
Is this legal and what do you think our rights are?
Well American law is largely based on English common law, I would say that as the contractor has bought the land it would be his to do with as he wants. However in the current finanacial climate I wouldnt have thought hed want to develop it. And as you flying rights to the strip he may not be able to do much without infringing on your rights so you may have a claim.
By the way Im not a lawyer Im what is called a screw in this country.
